Sexual Abuse Claims
Victims of sexual abuse suffer horrific injuries that often plague them for their entire lives. In 2019, Assembly Bill 218 came into effect allowing victims of childhood sexual abuse to file lawsuits for sexual abuse events that occurred years earlier. In effect, AB 218 “revived” or “re-opened” claims, including ones that were lost due to the running of statutes of limitations. However, the one-time reprieve and legal opportunity created by AB 218 WILL END ON DECEMBER 31, 2022.
In California Sexual Abuse and Cover-up Accountability Act of 2022, Assembly Bill 2777 will come into effect on January 1, 2023. For survivors seeking to recover damages for sexual assault and abuse occurring on or after January 1, 2009 which became barred due to the running of statutes of limitations, this Bill offers a reprieve from the statute of limitations defenses until December 31, 2026. AB 2777 also will revive claims seeking to recover damages suffered as a result of a sexual assault occurring on, or after, the victim’s 18th birthday against entities legally responsible for damages which engaged in a “cover-up,” as defined in the Bill.
